Terms of Use

Elitra (elitra.ai) is operated by Dennis Berry Coach, LLC, doing business as Elite Leaders Marketing, a Colorado limited liability company ("we," "us" or "our"). By using Elitra, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use Elitra.

1. Who can use Elitra

You must be at least 13 years old to use Elitra. If you are under 18, you may use Elitra only with the permission of a parent or legal guardian. If you use Elitra for a business, you confirm you have authority to accept these terms for it.

2. The service

Elitra offers free AI writing tools, design tools and related content. We may add, change, limit or remove features at any time, including usage limits. Free tools are offered as is, with no promise that they will always be available.

The AI writing tools require a free account, created by signing in with Google or with a link sent to your email. You are responsible for activity under your account and for keeping access to your email or Google account secure. Each person may have one account. You can delete your account at any time from the account page, and we may suspend or delete accounts that break these terms.

3. Acceptable use

You agree not to use Elitra to:

• Create or send spam, or mislead people about who you are.
• Create content that is illegal, hateful, harassing, threatening, sexually explicit, violent or deceptive.
• Impersonate any person or organization, or create fake reviews or testimonials.
• Infringe anyone's copyright, trademark, privacy or other rights, including by passing off someone else's post as your own.
• Access Elitra with bots, scripts, scrapers or other automated means, or call our APIs from outside the website.
• Get around usage limits, security checks or other protections, including by creating multiple accounts or using many devices or networks to avoid limits.
• Probe, attack or disrupt Elitra or the systems it runs on, or reverse engineer it.
• Resell or offer access to Elitra as part of another product or service.

We may block, limit or suspend access for anyone we believe is breaking these rules or abusing the service, with or without notice.

4. AI generated content

Results come from artificial intelligence and may be inaccurate, incomplete or similar to results other users receive. Review and edit everything before you publish it. You are responsible for what you post and how you use it. Results are not legal, financial, medical or other professional advice. If you work in a regulated field, check results against the rules that apply to you.

5. What you own

You keep any rights you have in the content you enter. As between you and us, you may use the results and designs you create with Elitra for any lawful purpose, including commercial use, and we claim no ownership of them. You give us permission to process your inputs only as needed to provide the service, as described in our Privacy Policy.

6. Our content and templates

The Elitra site, brand, software, articles, example posts and templates belong to us or our licensors. You may use our templates and example posts as a starting point for your own content. You may not copy, sell or distribute our templates, articles or library as a collection, or use them to build a competing service.

Stock photos from Unsplash and Pexels are provided under their own licenses, and fonts and icons under their open source licenses. You are responsible for following those licenses and for having the rights to any image you upload.

7. Copyright complaints

If you believe content on Elitra infringes your copyright, follow our DMCA policy.

8. Our relationship with Elite Leaders Marketing

Elitra is built and paid for by Elite Leaders Marketing. Links on Elitra to Elite Leaders Marketing and the Elite Leaders newsletter promote our own services. If we ever include affiliate links or sponsored content, we will label them clearly.

9. Disclaimer

Elitra is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non infringement. We do not promise that Elitra will be error free, secure or uninterrupted, or that results will produce any particular outcome, such as reach, followers or sales.

10. Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Elitra. Our total liability for any claim related to Elitra will not exceed one hundred US dollars ($100).

11. Indemnity

You agree to defend and hold us harmless from claims, losses and costs, including reasonable attorneys' fees, arising from your content, your use of Elitra or your breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction.

13. Changes

We may update these terms. The date at the top shows the latest version. If you keep using Elitra after a change, you accept the updated terms.
